Liability Waiver

Release for Participation in Bachata Sensual Orlando Classes, Workshops, Teams, and Events

By participating in any of our services, you agree to the terms of both the liability and COVID-19 related waivers below.

Liability Release

In exchange for participation in Bachata Sensual classes, workshops, teams, and events (the “Activity”), organized by Bachata Sensual Orlando LLC and/or Anastasia Nikolaeva & Jovanny Fuentes, located at Rhythm & Smooth Event Venue and/or other venues where the Activity may be hosted (“Releasee”):

1. I and anyone claiming on my behalf release and forever discharge Releasee and its affiliates, successors and assigns, officers, employees, representatives, partners, agents and anyone claiming through them (collectively, the “Released Parties”) from causes of action of any nature and kind, known or unknown, arising out of or relating to any injury, loss or damage to person and property that may be sustained as a result of participation in the Activity.
2. I understand that the Activity includes significant dance-related, solo and team-based, athletic movements. I understand that participation in the Activity involves inherent risks, including risk of physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent paralysis and/or death, and I assume all related risks and voluntarily participate in the Activity.
3. I agree to indemnify Releasee against any and all claims, actions, lawsuits, damages and judgments, including attorney’s fees, arising out of or relating to my participation in the Activity.
4. This Release shall not be construed as an admission by the Releasee that it has acted wrongfully.
5. This Release shall be binding upon the parties and their respective heirs, administrators, personal representatives, executors, successors and assigns. The terms of this Release shall be governed by the laws of the State of Florida.
6. I have carefully read and fully understand all the provisions of this Release and am freely, knowingly and voluntarily entering into this Release.

COVID-19 Release

I understand by choosing to participate in the Activity I am waiving COVID-related liability from the Releasee. I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the Releasee cannot guarantee that I will not become infected with the Coronavirus/COVID-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others.

I attest that:

• I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, headache, sore throat, or new loss of taste or smell.
• I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
• I have not been diagnosed with Coronavirus/COVID-19 and not yet cleared as non-contagious by state or local public health authorities.

I hereby release and agree to hold the Releasee harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss that may be caused by any act, or failure to act of the Releasee, or that may otherwise arise in connection with the Activity.
